By accessing or using any of our services, you (“Client,” “you,” or “your”) agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you may not access or use our services.
2. Definitions
“Company” refers to EZ Services, LLC dba EZ Lumper Services.
“Client” refers to any individual or entity requesting or paying for labor services from EZ Lumper Services.
“Lumper” refers to any independent contractor providing labor services through or on behalf of EZ Lumper Services.
“Service” refers to any labor assistance, including but not limited to container unloading, pallet restacking, transloading, sorting, and warehouse support.
“Platform” refers to EZ Lumper Services’ website, application, or other booking systems used to schedule, track, and pay for services.
3. Scope of Services
EZ Lumper Services provides on-demand and scheduled warehouse labor solutions nationwide. Our typical services include, but are not limited to:
Container and trailer unloading
Pallet restacking and transloading
Product sorting, staging, and segregation
General dock and warehouse labor support
The specific scope, crew size, rate, and timeline of any service are detailed in the service agreement or booking confirmation provided at the time of reservation. EZ Lumper Services acts solely as a labor coordination platform. Equipment, materials, and site access are the responsibility of the Client unless otherwise stated in writing.
4. Service Reservations & Payments
Booking: All reservations must be made through our website, app, or by phone.
Confirmation: A confirmation email or SMS will be sent upon successful booking.
Payment Methods: We accept payments via ACH, Zelle, T-Checks, Comcheks, EFS, Stripe, and credit card (4% fee applies).
Billing Terms: Weekly invoicing applies unless stated otherwise. Minimum weekly billing is $1,250 or per-contract terms.
Late Payments: Payments not received within fifteen (15) days of the invoice date are subject to a 10% late fee.
Minimum Commitments: Clients under subscription agreements must meet the minimum container or service threshold as defined in their plan. Shortfalls will be billed accordingly.
5. Cancellations & Rescheduling
Standard Notice: Cancellations or reschedules must be made at least 24 hours before the scheduled service.
Late Cancellation: Cancellations within 24 hours may incur a cancellation fee up to the full scheduled amount.
No-Show: Failure to provide site access or contact at the scheduled time may be billed as a completed service.
Rescheduling: We will make reasonable efforts to accommodate rescheduling requests based on crew availability.
6. Responsibilities & Liabilities
Client Responsibilities:
Ensure safe working conditions for all Lumpers, including compliance with OSHA standards.
Provide adequate lighting, space, and access for equipment if required.
Notify EZ Lumper Services of any site hazards or restrictions.
Lumper Status: All Lumpers are independent contractors, not employees of EZ Lumper Services. The Company assumes no liability for contractor tax obligations, benefits, or employment claims.
Damage & Liability: EZ Lumper Services is not liable for:
Preexisting product damage or concealed defects.
Delays caused by weather, traffic, site inaccessibility, or Client’s equipment failure.
Indirect, incidental, or consequential damages arising from service delays or performance.
Insurance: EZ Lumper Services maintains general liability coverage for coordination activities. Clients should maintain their own coverage for property, product, and warehouse operations.
7. Dispute Resolution
Any disputes or discrepancies related to services rendered must be reported within 24 hours of completion.
EZ Lumper Services reserves the right to investigate all claims and make final determinations.
In the event of a payment or service dispute, both parties agree to attempt good-faith resolution before pursuing legal remedies.
All disputes shall be governed by and construed under the laws of the State of Georgia, without regard to conflict-of-law provisions.
8. Termination
EZ Lumper Services may suspend or terminate any Client’s access to services for:
Repeated late or failed payments
Unsafe work environments
Violation of these Terms
Misuse or misrepresentation of services
Outstanding balances remain due upon termination.
9. Modifications to Terms
EZ Lumper Services reserves the right to amend, modify, or update these Terms at any time without prior notice. Significant changes will be communicated through email or posted on our website. Continued use of our services after updates constitutes acceptance of the new Terms.
